GENERAL INFORMATION This license governs the use of digital photographs sold as digital products under the “ChessboArt Photography” collection (“Photographs”). All Photographs are real photographs created by the artist. They are not generated, altered, or enhanced using generative artificial intelligence (AI). The photographs are created by Monika Burszczan and distributed by ChessboArt. By purchasing and downloading a Photograph, you agree to the terms of this license. --- 2. DIGITAL DELIVERY The Photograph is delivered as a digital product. After purchase, the Photograph is delivered: - via email and/or - via a secure digital download link provided by ChessboArt. No physical product is shipped. The buyer is responsible for providing a valid email address and for storing the downloaded file safely after delivery. --- 3. LICENSE GRANT Upon purchase, you are granted a non-exclusive, perpetual, non-commercial license to use the Photograph strictly under the conditions described in this license. This license is valid worldwide and has no time limitation. This license does not transfer ownership of copyright. --- 4. PERMITTED USES You are allowed to: - Use the Photograph for personal purposes, including wallpapers, framed prints, posters, or interior decoration. - Print the Photograph for personal use or for use by a chess club, school, cultural institution, or tournament organizer. - Use the Photograph to promote non-commercial chess-related activities, including chess tournaments, clubs, schools, and cultural events. - Publish the Photograph on websites or social media channels related exclusively to non-commercial chess or cultural activities. - Display the Photograph in physical spaces such as homes, chess clubs, schools, libraries, galleries, or cultural venues. --- 5. PROHIBITED USES You are not allowed to: - Resell, sublicense, redistribute, or share the Photograph in any form, whether free or paid. - Upload the Photograph to stock photography platforms, image libraries, marketplaces, NFT platforms, or download services. - Use the Photograph in products intended for sale, including merchandise, books, calendars, posters for sale, NFTs, or similar items. - Use the Photograph in commercial advertising, paid marketing campaigns, or promotions for third-party companies or brands. - Modify, manipulate, transform, or create derivative works from the Photograph, in whole or in part. This prohibition includes, without limitation: - any modification or enhancement using artificial intelligence (AI), - AI-based upscaling, restoration, recoloring, or retouching, - style transfer, generative fill, or creation of AI-generated derivatives, - training or fine-tuning of AI or machine learning models using the Photograph. The only permitted exception is purely technical resizing or format conversion required for personal printing, provided that the content, composition, colors, and artistic character of the Photograph are not altered. --- 6. ATTRIBUTION When the Photograph is used publicly (for example on websites, social media, or posters for chess or cultural events), attribution is recommended in the following form: “Photography by Monika Burszczan / ChessboArt” Attribution is not required for strictly private use. --- 7. RETURNS AND REFUNDS This product is a digital product. Due to the nature of digital downloads, the Photograph is not eligible for return, exchange, or refund once it has been delivered or made available for download, unless required otherwise by mandatory applicable law. --- 8. DISCLAIMER The Photograph is provided “as is”. ChessboArt and the artist do not guarantee specific printing results, colors, or appearance on different screens, printers, papers, or materials. The buyer is solely responsible for selecting print providers, materials, and printing methods. --- 9. COPYRIGHT All copyrights and moral rights remain with the photographer. Purchase of a Photograph grants usage rights only, as defined by this license. --- 10. TERMINATION Any use of the Photograph outside the scope of this license automatically terminates the granted rights. Upon termination, all use of the Photograph must cease immediately. --- 11. FINAL PROVISIONS This license is governed by applicable law. If any provision of this license is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
